The course focused on two titles of intellectual property law: patents and trademarks and  examines the rules of the laws and case-law of three jurisdictions: EU, US and China.

 

The exam is written and consists of two cases to be solved (one on patents and one on trademarks).

The exam after the end of class is going to be on 13 December.

 

Here are the details of the topics analyzed and a reference book, but generally the slides explainded in class and uploaded to ariel are sufficient.

 

-Introduction: What is intellectual property law; The source of the law.

 

- Patent: Patentable subject matter, novelty, inventive step/unobviousness, adequate disclosure and enablement, claim interpretation and infringement, remedies; Unitary Patent and Unitary Patent Court system.

 

- Trademark: Acquisition of trademark right, use vs. registration, trademark registrability and rights (distinctiveness, three -dimensional mark), infringement (likelihood of confusion and well known trademarks), defences (fair use), remedies, International enforcement.

 

 

 

Book: Transnational Intellectual Property Law (text and cases)[available also on Amazon] by Robert P. Merges, Seagull Haiyan Song. Part I (p. 3-22); Part II (p. 25 -243) and Part IV (p.481-625).  Only the case law in the book examined in class.
